Prije nego se odlu\u010dimo na taj korak, valja se prvenstveno informirati o propisima koji odre\u0111uju na koji na\u010din mo\u017eemo pristupiti tom zahvatu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Novi <em>Zakon o upravljanju i odr\u017eavanju zgrada<\/em> propisuje stro\u017ee uvjete zatvaranja lo\u0111e ili balkona. Na izgra\u0111enim zgradama ne smiju se izvoditi radovi nadogra\u0111ivanja, natkrivanja i zatvaranja balkona, lo\u0111a i terasa. U iznimnom slu\u010daju su dozvoljeni radovi natkrivanja i zatvaranja balkona, lo\u0111a i terasa, ako se takvi radovi izvode u skladu s propisima kojima se ure\u0111uje projektiranje, gra\u0111enje, uporaba i odr\u017eavanje gra\u0111evina, kao i s propisima kojima je propisana za\u0161tita kulturnih dobara, i to <strong>unificirano za cijelu zgradu.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Zadr\u017eavanje iste namjene (zatvoreni dio se ne pripaja stambenom prostoru)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ukoliko balkon ili lo\u0111a nakon zatvaranja zadr\u017eavaju svoju namjenu, \u0161to zna\u010di da zatvoreni prostor <strong>ne pripajamo<\/strong> stambenom prostoru i ne uklanjamo postoje\u0107e vanjske prozore i vrata, potrebno je izraditi glavni projekt.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sukladno odredbama iz <em>Pravilnika o jednostavnim i drugim gra\u0111evinama i radovima<\/em> propisano je da se <strong>bez gra\u0111evinske dozvole, a u skladu s glavnim projektom<\/strong> mogu izvoditi radovi na postoje\u0107oj zgradi (ako tim <em>Pravilnikom<\/em> nije propisano druga\u010dije), a kojima se dodaju, obnavljaju ili zamjenjuju dijelovi zgrade koji su dio omota\u010da grijanog ili hla\u0111enog dijela zgrade, kao \u0161to su prozirni elementi pro\u010delja, toplinska izolacija podova, zidova itd. Navedeno se smatra poslovima redovitog odr\u017eavanja, koji se mogu izvoditi uz prikupljenu suglasnost natpolovi\u010dne ve\u0107ine suvlasnika.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Mijenjanje namjene (zatvoreni dio se pripaja stambenom prostoru)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U slu\u010daju da balkon ili lo\u0111a nakon zatvaranja ne zadr\u017eava svoju namjenu i <strong>pripaja se stambenom prostoru<\/strong>, tada se radi o rekonstrukciji, te je potrebno sukladno odredbama <em>Zakona o gradnji<\/em> <strong>ishoditi gra\u0111evinsku dozvolu.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Jedinstveni projekt za cijelu zgradu<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Umjesto dosada\u0161njeg pojedina\u010dnog zatvaranja lo\u0111e ili balkona, po novim propisima to je i dalje mogu\u0107e ostvariti, no potrebna projektna dokumentacija se izra\u0111uje <strong>na razini cijele zgrade<\/strong>, a ne pojedina\u010dnog stana.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Izradom jedinstvene tehni\u010dke dokumentacije za eventualne preinake na pro\u010deljima ne obvezuje se suvlasnike na izvedbu radova, ve\u0107 se sama zatvaranja mogu izvesti ovisno o mogu\u0107nostima i potrebama, a sve u skladu s jedinstvenim projektom. Naknadne preinake na pro\u010delju zgrade mogu\u0107e je izvoditi jedino uz uva\u017eavanje odredbi mjerodavnih propisa i suglasnosti suvlasnika, sukladno odredbama <em>Zakona.<\/em><\/p>","protected":false},"excerpt":{"rendered":"<p>Zatvaranje lo\u0111e ili balkona mo\u017ee biti rje\u0161enje za dobivanje dodatnog prostora u stanu te bolju za\u0161titu od vremenskih uvjeta.
